Taxpayer fairness by Tony Margaritelli

What a couple of months it’s been since the last issue. We’ve all had to manage and survive the January tax return filing madness and yet again it seems that about one million returns failed to get filed, which I believe was about the same number last year.

We all watched Mr Bates vs The Post Office, which resulted in an unprecedented outpouring of public support for those sub-postmasters who were so badly wronged. We had HMRC finally throw in the IR35 towel in the Kaye Adams case after 10 years – think about it for a moment, 10 years! As I type, and basically as a result of these two issues, we are seeing significantly more coverage and momentum building around, as Dave Chaplin puts it, “the iniquitous Loan Charge [that] has ambushed over 50,000 people with extortionate back tax bills, devastating families—bankrupting parents and driving some to take their own lives out of sheer desperation”. While all this has been unfolding, we are seeing HMRC rejecting R&D claims on an industrial scale, quoting all manner of reasons for delays and non-payments. This includes liberal use of the phrase: “The claim triggered an alert on our systems and has caused HMRC to believe that you have fraudulently claimed money to which you are not entitled. Therefore, HMRC has blocked payment of this money, to which we believe you are not entitled.”
